The user may request erasure if one of the following conditions is met:
- The personal data are no longer necessary for the purposes for which they were collected or otherwise processed;
- The user withdraws his/her consent on which the processing of the data is based and there is no other legal basis for the processing;
- The data subject objects to the processing and there are no overriding legitimate grounds for the processing;
- The personal data have been processed unlawfully;
- The personal data must be erased for compliance with a legal obligation under Union or Member State law to which the controller is subject;
- The personal data have been collected in connection with the offering of information society services to children and consent has been given by the holder of parental responsibility for the child.
The user has the right to restrict the processing of his or her personal data by the controller where:
- He or she contests the accuracy of the personal data. In this case, the restriction of processing shall be for a period enabling the controller to verify the accuracy of the personal data;
- The processing is unlawful but the user does not wish the personal data to be erased but requests the restriction of their use instead;
- The controller no longer needs the personal data for the purposes of the processing, but the user requires them for the establishment, exercise or defence of legal claims;
- Object to the processing pending verification of whether the legitimate grounds of the controller override the interests of the User.
Right to portability.
The data subject shall have the right to receive the personal data concerning him or her, which he or she has provided to a controller, in a structured, commonly used and machine-readable format and shall have the right to transmit those data to another controller without hindrance from the controller to whom the personal data have been provided, where the processing is based on consent or a contractual obligation and the processing is carried out by automated means. When exercising the right to data portability, the data subject shall also have the right to obtain the direct transmission of the personal data from one controller to another, where technically feasible.
Right to object.
Users shall have the right to object to the processing of their personal data to the controller. The personal data administrator is obliged to terminate the processing unless he proves that there are compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or for the establishment, exercise or defence of legal claims. In the event of an objection to the processing of personal data for direct marketing purposes, the processing shall be terminated immediately.
Complaint to the supervisory authority
Every User has the right to lodge a complaint against unlawful processing of his personal data with the Personal Data Protection Commission or with the competent court.
